1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your use of the website, services, estimates, appointments, repairs, roadside assistance, towing, mobile tire and battery services, mobile mechanic services, and other services provided by Barnett Mobile Auto Solutions LLC, doing business as Rod’s Roadside Service (“Rod’s Roadside Service,” “we,” “us,” or “our”).

By requesting service, scheduling an appointment, approving an estimate or work order, making a payment, electronically signing an authorization, or otherwise using our services, you acknowledge that you have read, understand, and agree to these Terms.

If you do not agree to these Terms, do not authorize or use our services.

2. Business & Service Model

Barnett Mobile Auto Solutions LLC d/b/a Rod’s Roadside Service is a mobile automotive service provider based in Opelika, Alabama. We provide roadside assistance, mobile mechanic and diagnostic services, mobile tire and battery services, light-duty towing, fleet services, and other automotive services as offered from time to time.

Rod’s Roadside Service operates primarily as a mobile service and does not operate as a traditional customer drop-off repair facility. Services are generally performed at the customer’s location, roadside location, or another mutually agreed-upon service location, subject to accessibility, safety, service-area limitations, technician availability, equipment requirements, and applicable law.

Our published mailing address is for mailing and business correspondence purposes and should not be considered a customer service, vehicle drop-off, or repair location unless we expressly state otherwise.

We may use qualified independent service providers or subcontractors when appropriate. The use of such providers does not change the customer’s obligation to comply with these Terms or the terms of the applicable estimate, work order, or service authorization.

3. Business Hours, Emergency & After-Hours Service

Rod’s Roadside Service maintains regular business hours for scheduled mobile mechanic, diagnostic, repair, tire, battery, towing, and other automotive services. Regular business hours are generally Monday through Friday, 8:00 a.m. to 6:00 p.m.; Saturday, 9:00 a.m. to 2:00 p.m.; and Sunday, closed, unless otherwise posted or communicated.

Emergency roadside assistance may be available outside regular business hours; however, after-hours availability is not guaranteed. Availability depends on technician availability, location, weather, safety conditions, service type, equipment requirements, and other operational factors.

After-hours, weekend, holiday, expedited, same-day, or emergency services may be subject to additional service-call, travel, labor, dispatch, mileage, or emergency-service charges. Any applicable charges will be disclosed through an estimate, work order, booking, invoice, or other communication when reasonably practicable before service is performed.

References to “24/7 roadside service,” “24-hour emergency service,” or similar language indicate that emergency service may be requested outside regular business hours and do not guarantee technician availability, a specific response time, or continuous staffing at all hours.

4. Estimates, Pricing & Authorization

Estimates provided by Rod’s Roadside Service are based on the information available at the time the estimate is prepared and are not a guarantee of the final cost unless expressly stated as a fixed-price service. Vehicle condition, diagnostic findings, parts availability, additional damage, incorrect customer-provided information, accessibility, and other unforeseen conditions may affect the final price.

Service call, dispatch, travel, mileage, diagnostic, inspection, labor, parts, materials, towing, after-hours, expedited, emergency, disposal, shop-supply, processing, or other applicable charges may be separately itemized on an estimate, work order, or invoice.

Service Call/Travel Charges: A service call, dispatch, or travel charge compensates Rod’s Roadside Service for dispatching to the service location and may apply regardless of whether the requested repair or service can ultimately be completed. Unless expressly stated otherwise in writing, a service call or travel charge is separate from labor, parts, diagnostic, towing, and other charges.

The customer is responsible for providing accurate vehicle information, symptoms, service location, contact information, and other information reasonably necessary to prepare an estimate and perform the requested service.

No additional repair or service materially outside the authorized scope will be performed without customer authorization. Authorization may be provided electronically, including through an approved estimate or work order, electronic signature, text message, email, online booking, recorded authorization where permitted by law, or another documented method.

If additional work, parts, labor, diagnostic testing, or services become necessary after work begins, Rod’s Roadside Service may provide a revised or supplemental estimate. The customer may approve or decline the additional work. Declining additional work does not eliminate charges already incurred for authorized services, diagnostics, labor, travel, parts, or other applicable charges.

5. Deposits, Prepayments & Payment Terms

Rod’s Roadside Service may require a deposit, partial prepayment, service-call payment, or full payment before scheduling, dispatching, ordering parts, or beginning certain services. The amount required may vary depending on the type of service, parts cost, travel distance, scheduling requirements, and other circumstances of the job.

Deposits: When a deposit is required, the deposit will be applied toward the customer’s authorized service balance. Work or an appointment is not considered fully secured until any required deposit or prepayment has been received.

Dispatch and Service-Call Payments: Roadside, emergency, same-day, expedited, towing, diagnostic, or other mobile services may require payment of the applicable service-call, dispatch, travel, diagnostic, or other initial charge before a technician is dispatched.

Parts Prepayment: Rod’s Roadside Service may require partial or full payment for parts before the parts are purchased or ordered. Special-order parts are subject to the separate Special-Order Parts provisions contained in these Terms.

Balance Due: Unless otherwise stated in writing, the remaining balance is due immediately upon completion of the authorized service. For services billed in stages, the applicable payment may become due upon completion of each authorized stage.

The customer remains responsible for authorized labor, diagnostics, service-call, travel, towing, parts, materials, and other charges already incurred even if the customer later declines additional recommended work.

Payments are subject to any additional written payment terms disclosed on the applicable estimate, work order, invoice, booking confirmation, or service authorization.

Unpaid Balances & Mechanic’s Lien Rights

All amounts due for authorized labor, parts, materials, diagnostics, towing, roadside assistance, and other services are payable according to the applicable estimate, work order, invoice, or other agreed payment terms.

If an amount lawfully due remains unpaid, Barnett Mobile Auto Solutions LLC d/b/a Rod’s Roadside Service reserves any mechanic’s, materialman’s, possessory, statutory, contractual, collection, or other lien rights and remedies that may be available under applicable Alabama law.

Nothing in these Terms grants Rod’s Roadside Service a lien, right to retain possession, right to repossess, right to remove installed parts, or right to sell or dispose of a vehicle beyond what is actually permitted by applicable law. Any lien or collection remedy will be exercised only in accordance with applicable legal requirements.

The customer remains responsible for valid unpaid charges regardless of whether a lien remedy is available.

6. Cancellations, No-Shows & Service Declination

Because Rod’s Roadside Service is a mobile service provider, appointments reserve technician time, travel time, equipment, and scheduling capacity. Cancellation, rescheduling, no-show, and service-declination charges may therefore apply.

Cancellation Before Dispatch: A customer who needs to cancel or reschedule should contact Rod’s Roadside Service as soon as possible. Any refund or cancellation charge will be determined according to the applicable booking, estimate, work order, parts commitment, and costs already incurred.

After Dispatch: Once a technician has been dispatched or is traveling to the service location, applicable service-call, dispatch, travel, mileage, diagnostic, cancellation, or other committed charges may become non-refundable.

After Arrival: If the technician arrives at the provided service location and the customer cancels, declines the authorized service, is unavailable, cannot provide access to the vehicle, or otherwise prevents the service from being performed, the customer remains responsible for applicable service-call/travel charges and any authorized labor, diagnostic, towing, parts, or other charges already incurred.

No-Shows and Inaccessible Vehicles: A customer may be treated as a no-show when the technician cannot reasonably contact the customer, locate the vehicle using the information provided, obtain necessary access, or safely perform the requested service because of circumstances within the customer’s control.

Incorrect Address or Information: Additional charges may apply when inaccurate or incomplete service-location, vehicle, or booking information results in additional travel, delay, rescheduling, or an unsuccessful service attempt.

Parts and Special Orders: Cancellation of a service involving parts is also subject to the parts, restocking, and Special-Order Parts provisions contained in these Terms.

Rod’s Roadside Service may waive or modify a cancellation or no-show charge at its discretion when circumstances reasonably warrant doing so. Any waiver in one instance does not require a waiver in future instances.

7. Diagnostics & Diagnostic Fees

Diagnostic services compensate Rod’s Roadside Service for technician time, professional knowledge, testing procedures, diagnostic equipment, research, and evaluation. Diagnostic charges are due for the diagnostic service performed and are not contingent upon the customer authorizing or purchasing a recommended repair.

A diagnostic evaluation is based on the symptoms, vehicle condition, information available, and testing results present at the time of service. Automotive problems may be intermittent, involve multiple systems or components, or require additional testing after an initial problem is identified.

A diagnostic service does not guarantee that every existing or future vehicle problem will be identified during a single visit, nor does the identification or repair of one problem guarantee that another unrelated condition does not exist.

Additional Diagnostic Time: If additional testing or diagnostic time beyond the originally authorized scope is reasonably necessary, Rod’s Roadside Service will seek additional authorization before performing additional chargeable diagnostic work.

Third-Party Diagnoses: If a customer requests replacement or repair of a specific component based upon a diagnosis provided by another mechanic, repair facility, parts store, scan tool, internet source, or other third party, Rod’s Roadside Service does not guarantee the accuracy of that diagnosis.

If the customer directs Rod’s Roadside Service to perform a specific repair without authorizing our recommended diagnostic procedure, the customer remains responsible for the authorized repair charges even if that repair does not correct the original complaint, provided the authorized work was properly performed.

Diagnostic findings and recommendations reflect the vehicle’s condition at the time of inspection and do not constitute a guarantee of the vehicle’s future condition or reliability.

8. Parts, Special Orders & Customer-Supplied Parts

Parts Supplied by Rod’s Roadside Service: Parts supplied by Rod’s Roadside Service are selected based on available vehicle information, supplier catalogs, manufacturer information, and other reasonably available fitment data. Parts availability, pricing, shipping, and delivery times may change and are not guaranteed until an order is accepted by the applicable supplier.

Parts Prepayment: Rod’s Roadside Service may require partial or full payment for parts before ordering or purchasing them.

Special-Order Parts: Special-order parts may require 100% prepayment before the order is placed. A special-order part may be non-refundable or non-returnable when the supplier or manufacturer does not accept returns, the part was specifically ordered for the customer’s vehicle, or the part has been programmed, coded, modified, painted, installed, or otherwise made ineligible for return.

Parts Returns: An uninstalled part may be eligible for return only when Rod’s Roadside Service and the applicable supplier or manufacturer permit the return. Return eligibility is not guaranteed.

Restocking & Return Costs: Approved returns may be subject to applicable supplier charges, shipping, freight, handling, and a restocking fee of up to 20% where applicable. The customer is responsible for applicable return costs when the return results from the customer’s cancellation, change of mind, incorrect information, or other circumstances attributable to the customer.

Installed Parts: Parts that have been installed generally cannot be returned merely because the customer changes their mind. A defective installed part will instead be handled under the applicable warranty provisions.

Customer-Supplied Parts: Customer-supplied parts are accepted only at the discretion of Rod’s Roadside Service. The customer is responsible for the part’s accuracy, fitment, compatibility, completeness, quality, and condition.

Rod’s Roadside Service provides no parts warranty on customer-supplied parts. Any manufacturer or seller warranty applicable to a customer-supplied part is the customer’s responsibility.

If a customer-supplied part is incorrect, defective, damaged, incomplete, or otherwise prevents completion of the service, labor and diagnostic work already performed remain payable. Additional labor, diagnostic, service-call, travel, or return-trip charges may apply to complete the repair after the correct part becomes available.

Nothing in this section limits rights that cannot legally be waived.

9. Rusted, Seized, Broken & Pre-Existing Components

Vehicles may contain components that are worn, rusted, corroded, seized, brittle, stripped, cross-threaded, previously damaged, improperly installed, previously repaired, or otherwise deteriorated before Rod’s Roadside Service begins work.

During reasonable diagnosis, disassembly, removal, repair, or installation, a pre-existing weakened or deteriorated component may break, crack, strip, seize, separate, or otherwise become unusable.

Examples may include bolts, nuts, studs, lug nuts, wheel studs, spark plugs, battery terminals, electrical connectors, wiring, hoses, fittings, clips, plastic components, hubs, rotors, suspension fasteners, exhaust fasteners, and other aged or deteriorated components.

Rod’s Roadside Service will use reasonable care and appropriate service procedures but cannot guarantee that deteriorated, seized, corroded, previously damaged, or improperly installed components can be removed or serviced without additional damage or replacement.

If an unforeseen condition requires additional labor, extraction, repair, replacement parts, specialized equipment, or additional service, the customer will be informed and additional authorization will be obtained before material additional chargeable work is performed when reasonably practicable.

Additional labor and parts required because of a pre-existing condition are not automatically included in the original estimate.

Rod’s Roadside Service is not responsible for a pre-existing or unrelated vehicle condition merely because that condition becomes apparent during or after authorized service. This provision does not relieve Rod’s Roadside Service of responsibility for damage directly caused by negligent workmanship or other liability that cannot legally be excluded.

10. Mobile Tire, Battery & Roadside Assistance

Rod’s Roadside Service provides various mobile tire, battery, and roadside-assistance services. The availability and suitability of any particular service depend on vehicle condition, location, equipment requirements, safety conditions, and other circumstances.

Jump Starts: A jump start is intended to attempt to start a vehicle with a discharged or insufficient battery. A successful jump start does not establish that the battery, alternator, starter, charging system, wiring, or other electrical components are in good condition and does not guarantee that the vehicle will restart after being turned off.

Battery Service: Battery replacement or installation does not correct unrelated charging-system, starter, wiring, electrical, or parasitic-draw problems. Additional diagnostic testing may be recommended when appropriate.

Tire Service: Not every damaged tire can be safely repaired. Repairability depends on puncture location and size, tire condition and age, previous repairs, internal damage, and other applicable safety considerations. Rod’s Roadside Service may decline to repair or install a tire that appears unsafe, unsuitable, damaged, or incompatible with the vehicle.

Spare Tires: The customer is responsible for the condition and suitability of a customer-provided spare tire. Rod’s Roadside Service cannot guarantee the age, internal condition, remaining service life, or roadworthiness of a customer-provided spare.

Wheel Locks & Lug Hardware: Customers are responsible for providing the appropriate wheel-lock key when required. Missing wheel-lock keys or damaged, seized, stripped, swollen, cross-threaded, or otherwise defective lug nuts, wheel studs, or wheel hardware may prevent ordinary tire service or result in additional authorized charges.

Fuel Delivery: Customers are responsible for providing accurate fuel-type information. Delivery of fuel does not guarantee that a vehicle will start when another mechanical, electrical, fuel-system, or security-system problem exists.

Vehicle Lockouts: Rod’s Roadside Service will use reasonable care when attempting vehicle-entry services. Certain vehicles or circumstances may require a locksmith, dealership, manufacturer assistance, or another specialized provider.

Roadside Safety: Rod’s Roadside Service may decline, delay, relocate, or discontinue roadside service when traffic, weather, vehicle position, surroundings, or other conditions create an unreasonable safety risk.

Completion of roadside assistance does not constitute a complete mechanical or safety inspection of the vehicle.

11. Towing, Winching & Recovery

Rod’s Roadside Service may provide light-duty towing, winching, recovery, and related roadside services when the vehicle, location, conditions, and required equipment are within our service capabilities.

Towing Authorization: By requesting and authorizing towing service, the customer represents that they are the vehicle owner or otherwise have authority to authorize the vehicle to be moved and authorizes Rod’s Roadside Service to transport the vehicle to the agreed destination.

Vehicle Information: The customer is responsible for accurately disclosing relevant information including vehicle year, make and model, drivetrain when known, vehicle condition, accident damage, missing or damaged wheels, steering or suspension damage, modifications, lowered suspension, oversized wheels or tires, and other conditions that may affect safe towing.

Towing Equipment: Depending on the vehicle and circumstances, towing may require wheel-lift equipment, dollies, winching, recovery equipment, or other appropriate procedures. Additional equipment, labor, mileage, or recovery work may result in additional charges when applicable.

Modified & Low-Clearance Vehicles: Lowered vehicles, aftermarket suspension, body modifications, oversized wheels or tires, aerodynamic components, and other modifications may increase the risk or complexity of loading, towing, or recovery. Rod’s Roadside Service may decline service when safe clearance or attachment cannot reasonably be achieved.

Accident-Damaged or Disabled Vehicles: Collision-damaged or severely disabled vehicles may contain hidden structural, steering, suspension, wheel, tire, drivetrain, or body damage. Moving, loading, unloading, or recovering such a vehicle may cause existing damage to shift, separate, or become more apparent. Rod’s Roadside Service is not responsible for pre-existing collision or mechanical damage merely because it becomes apparent during towing or recovery.

Winching & Recovery: Winching and recovery may involve ditches, mud, soft ground, slopes, confined areas, damaged vehicles, or other difficult conditions. Recovery operations can place stress on already damaged or deteriorated components. Rod’s Roadside Service may refuse or discontinue a recovery when conditions exceed our equipment capabilities or create an unreasonable safety risk.

Personal Property & Cargo: Customers should remove or secure valuables, loose property, and cargo before towing whenever reasonably possible. Rod’s Roadside Service is not responsible for loss or damage caused by unsecured cargo or pre-existing conditions, except to the extent responsibility cannot legally be excluded.

Towing Destination: The customer is responsible for providing an appropriate and accessible destination and obtaining any permission necessary for the vehicle to be left at that location.

Vehicle Storage: Rod’s Roadside Service does not currently provide vehicle storage unless specifically agreed otherwise in writing.

Cancellation After Dispatch: Once a tow truck has been dispatched, applicable service-call, dispatch, mileage, travel, or GOA charges may remain due if the customer cancels or the vehicle no longer requires towing. If hookup, dollies, winching, recovery, loading, or other work has already begun, additional applicable charges may also be due.

Rod’s Roadside Service will use reasonable care and appropriate procedures when performing towing and recovery services. Nothing in these Terms excludes responsibility for negligent workmanship or other liability that cannot legally be excluded.

12. Limited Labor / Workmanship Warranty

Unless a different written warranty is specifically stated on the applicable estimate, work order, or invoice, qualifying workmanship performed by Rod’s Roadside Service is covered by a limited labor/workmanship warranty for 90 days or 3,000 miles from the service completion date, whichever occurs first.

What the Warranty Covers: This warranty covers qualifying defects determined to result directly from Rod’s Roadside Service’s workmanship on the originally authorized repair or service. When a covered workmanship issue is confirmed, the primary remedy will generally be correction or reperformance of the affected covered labor.

Warranty Begins: The warranty period begins on the documented service completion date. Mileage limitations are measured from the mileage documented at or near completion when mileage is available.

Warranty Inspection: A customer who believes there is a warranty-related problem must contact Rod’s Roadside Service as soon as reasonably possible and provide information about the concern. Rod’s Roadside Service must be given a reasonable opportunity to inspect and diagnose the affected work.

Because Rod’s Roadside Service is mobile, an applicable service-call, travel, and/or diagnostic charge may initially be required for a warranty inspection. If the condition is confirmed to result directly from covered workmanship, the applicable warranty inspection/service-call charge may be credited or refunded as appropriate. If the condition is unrelated to covered workmanship, applicable service-call, travel, diagnostic, and repair charges remain the customer’s responsibility.

Repairs by Another Provider: Except where immediate action is reasonably necessary for safety or to prevent additional vehicle damage, the customer should not allow another person or repair provider to remove, disassemble, alter, adjust, or repair the affected work before Rod’s Roadside Service has been given a reasonable opportunity to inspect it. Doing so may affect warranty coverage when the third-party work prevents us from determining the cause of the claimed failure.

Warranty Exclusions: This limited workmanship warranty does not cover failures or damage caused by normal wear and tear, abuse, misuse, collision, road hazards, overheating, lack of maintenance, rust or corrosion, water or flood damage, vehicle modifications, racing or abnormal use, pre-existing conditions, unrelated component failures, defective customer-supplied parts, subsequent third-party work, or continued vehicle operation after serious warning signs or symptoms.

Customer-Supplied Parts: Rod’s Roadside Service provides no warranty on the part itself when a customer supplies the part. A qualifying condition determined to result directly from Rod’s Roadside Service’s workmanship may still be covered by this limited workmanship warranty.

No Whole-Vehicle Warranty: Repairing or servicing one component or system does not constitute a warranty, inspection, or guarantee of the entire vehicle or of components unrelated to the authorized service.

This warranty provides the coverage stated above and does not limit any rights or remedies that cannot legally be waived under applicable law.

13. Parts, Battery, Tire & Manufacturer Warranties

Parts, batteries, tires, and other products supplied by Rod’s Roadside Service may include a warranty provided by the applicable manufacturer, distributor, supplier, or third-party warranty administrator. Unless Rod’s Roadside Service expressly provides a separate written warranty, the terms, limitations, eligibility requirements, and duration established by the applicable warranty provider control the product warranty.

Parts Warranty: A manufacturer or supplier warranty generally applies to the covered part itself and does not automatically extend Rod’s Roadside Service’s labor/workmanship warranty or create an additional labor warranty.

Battery Warranty: Batteries supplied by Rod’s Roadside Service may be covered by the applicable manufacturer or distributor warranty. Battery warranty eligibility, testing requirements, replacement terms, prorated coverage, and exclusions are determined by the applicable warranty provider.

Battery discharge or failure resulting from an alternator, starter, wiring fault, parasitic draw, charging-system problem, improper use, vehicle condition, or another unrelated cause does not automatically establish that the battery is defective.

Tire Warranty: Tires supplied by Rod’s Roadside Service may carry applicable manufacturer or distributor warranties. Warranty eligibility is determined according to the applicable warranty program and may depend on tire condition, wear, maintenance, damage, and other program requirements.

Road-Hazard Coverage: Road-hazard protection applies only when such coverage was specifically purchased, included, or otherwise documented for the applicable tire. Road-hazard claims are subject to the terms, exclusions, limits, and procedures of the applicable road-hazard program.

Warranty Replacement Labor & Mobile Charges: A manufacturer, distributor, supplier, battery, tire, or road-hazard warranty providing a replacement or credit for a product does not automatically cover mobile service-call charges, travel, mileage, diagnostics, towing, removal, installation, programming, shipping, or replacement labor. Those charges remain payable unless expressly covered by the applicable warranty or waived by Rod’s Roadside Service.

Warranty Claims: Customers may be required to provide the original invoice or other purchase information and make the vehicle or affected part available for reasonable inspection or testing before a warranty claim can be processed.

Rod’s Roadside Service will reasonably assist with applicable warranty claims for products we supplied when appropriate; however, approval of a manufacturer, supplier, distributor, or third-party warranty claim is ultimately subject to that warranty provider’s terms and determination.

Nothing in this section limits warranty rights or remedies that cannot legally be waived.

Multiple Parts Suppliers: Rod’s Roadside Service may obtain parts, batteries, tires, and other products from various manufacturers, distributors, wholesalers, retailers, and automotive-parts suppliers. Warranty coverage may differ depending on the specific product and supplier used for a particular repair. The applicable warranty, if any, will be determined by the product and supplier associated with that transaction and may be identified on the customer’s estimate, work order, invoice, receipt, or other warranty documentation.

14. Customer Responsibilities & Safety

Customers are responsible for cooperating with Rod’s Roadside Service and providing reasonably accurate information and safe access necessary to perform authorized services.

Vehicle Information: The customer is responsible for providing accurate vehicle information when reasonably requested, including year, make, model, engine, VIN, tire size, battery information, drivetrain, modifications, mileage, symptoms, and other information relevant to the requested service.

Service Location: The customer must provide an accurate service location and disclose known access restrictions or hazards, including gated properties, parking structures, highways, restricted areas, soft ground, steep grades, low-clearance areas, or unsafe traffic conditions.

Vehicle Access: The customer is responsible for providing reasonable access to the vehicle, including keys, wheel-lock keys, authorization to enter or move the vehicle, and any other items reasonably necessary to perform the authorized service.

Authority to Authorize Service: The person requesting service represents that they are the vehicle owner or otherwise have authority to authorize the requested diagnosis, repair, roadside assistance, towing, or other service.

Known Conditions: Customers should disclose known mechanical problems, prior repairs, modifications, accident damage, electrical problems, fluid leaks, missing components, or other conditions that may reasonably affect the requested service.

Safe Working Environment: Customers and other persons should maintain a reasonable distance from the work area and follow technician safety instructions. Children, pets, bystanders, and unnecessary persons should be kept away from active repair, towing, tire, battery, winching, or recovery operations.

Roadside Locations: Customers should remain in a reasonably safe location whenever service is being performed near moving traffic. Rod’s Roadside Service may require the vehicle to be relocated or may decline or discontinue service when roadside conditions create an unreasonable risk.

Unsafe Vehicles: Rod’s Roadside Service may advise that a vehicle should not be driven when an observed condition appears unsafe. If a customer chooses to operate the vehicle after receiving such a warning, the customer assumes responsibility for that decision to the extent permitted by applicable law.

Declined Repairs: Customers may decline recommended repairs or additional diagnostic work. Rod’s Roadside Service is not responsible for consequences resulting from continued operation with a known or disclosed condition that the customer declined to repair, except to the extent otherwise required by law.

Personal Property: Customers are responsible for reasonably securing personal belongings, valuables, tools, equipment, and cargo in or around the vehicle before service or towing.

Rod’s Roadside Service reserves the right to refuse, postpone, relocate, or discontinue service when conditions create an unreasonable safety risk, when required information or authorization cannot be obtained, or when threatening, abusive, or dangerous conduct occurs. Applicable charges already incurred may remain payable.

15. SMS/Text Messaging Terms

Barnett Mobile Auto Solutions LLC d/b/a Rod’s Roadside Service may offer customers the option to receive SMS and/or MMS text messages regarding service requests, appointments, dispatch and estimated-arrival updates, roadside or towing services, estimates, repair-status updates, parts-status updates, invoices, payments, warranty matters, customer-service communications, follow-up communications, and other messages consistent with the consent provided.

SMS Consent: By providing a mobile telephone number and affirmatively opting in to an applicable SMS messaging program, the customer consents to receive text messages from Barnett Mobile Auto Solutions LLC d/b/a Rod’s Roadside Service consistent with that consent. Providing a telephone number by itself does not constitute consent to receive promotional or marketing text messages.

Marketing Messages: Promotional or marketing SMS/MMS messages will be sent only when appropriate consent has been obtained. Consent to receive promotional or marketing messages is not a condition of purchasing goods or services.

Message Frequency: Message frequency varies depending on the customer’s service requests, appointments, account activity, and the messaging program for which the customer provided consent.

Message and Data Rates: Message and data rates may apply according to the customer’s wireless service plan.

Opt-Out: Customers may opt out of applicable text messages at any time by replying STOP. After an applicable opt-out request is processed, messages covered by that consent will stop, except for an appropriate opt-out confirmation or communications otherwise permitted by law.

Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages. Message delivery may depend on carrier service, device availability, network conditions, and other circumstances outside our reasonable control.

Privacy: Mobile telephone numbers, SMS opt-in information, and SMS consent information are handled according to our Privacy Policy. We do not sell, rent, or share mobile telephone numbers, SMS opt-in data, or SMS consent information with third parties or affiliates for their own marketing or promotional purposes. Information may be shared with service providers acting on our behalf when reasonably necessary to operate and deliver our communications.

Customers should review our Privacy Policy for additional information concerning the collection, use, disclosure, and retention of personal and mobile information.

16. Liability & Vehicle Downtime

Rod’s Roadside Service will use reasonable care in performing authorized services. Automotive vehicles, however, may contain pre-existing defects, worn components, hidden damage, previous repairs, modifications, or unrelated mechanical or electrical conditions that are not caused by the service being performed.

Pre-Existing and Unrelated Conditions: Rod’s Roadside Service is not responsible for a pre-existing or unrelated condition merely because it becomes apparent during or after diagnosis, repair, roadside assistance, towing, or another authorized service.

Vehicle Downtime: Automotive diagnosis, parts availability, repairs, warranty evaluations, supplier delays, and mechanical failures may result in vehicle downtime. Customers should make alternative transportation arrangements when appropriate.

Indirect and Consequential Losses: To the fullest extent permitted by applicable law, Rod’s Roadside Service does not automatically assume responsibility for indirect, incidental, special, or consequential losses arising from ordinary vehicle downtime or an unrelated vehicle failure, including rental-vehicle expenses, rideshare expenses, missed work, lost wages, lost profits, business interruption, lodging expenses, missed appointments, or travel interruption.

Customer-Directed Repairs: Rod’s Roadside Service is not responsible for an incorrect diagnosis supplied by a customer or third party when the customer specifically directs us to perform a repair based on that diagnosis, provided the authorized work itself was properly performed.

Declined Services: Rod’s Roadside Service is not responsible for damage or additional failure resulting from a customer’s decision to decline a recommended repair, diagnostic procedure, towing recommendation, or safety recommendation, except to the extent otherwise required by law.

Delays Outside Our Control: Rod’s Roadside Service is not responsible for reasonable delays caused by severe weather, traffic, road closures, accidents, supplier or parts delays, telecommunications outages, equipment failure, government action, emergencies, or similar circumstances outside our reasonable control.

No Whole-Vehicle Guarantee: Completion of a repair, diagnostic service, roadside service, inspection, or towing service does not represent that the entire vehicle has been inspected or certified as mechanically sound, roadworthy, or free from other defects unless such an inspection was specifically included in the authorized service.

Limitation: Nothing in these Terms is intended to exclude or limit responsibility for negligent workmanship, willful misconduct, or any liability, warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law.

17. General Legal Terms

Independent Service Providers: Rod’s Roadside Service generally performs services directly but may occasionally use, refer, or coordinate with qualified independent service providers when appropriate. Relevant customer, vehicle, and service information may be shared as reasonably necessary to coordinate authorized services and in accordance with our Privacy Policy.

Electronic Records: Estimates, work orders, invoices, electronic signatures, approvals, text messages, emails, photographs, payment records, and other electronic communications may be retained as business records and may be used to document service requests, authorization, completion, warranty matters, payment disputes, or other transactions.

Privacy Policy: Collection, use, disclosure, and retention of personal information are governed by our Privacy Policy, which is incorporated into these Terms where applicable.

Changes to These Terms: Rod’s Roadside Service may update these Terms as our services, technology, business practices, vendors, or legal requirements change. The current version will be posted on our website with an updated “Last Updated” date.

Severability: If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or severed to the extent necessary, and the remaining provisions will continue to the extent permitted by law.

No Waiver: Failure to enforce a provision of these Terms on one occasion does not automatically waive the right to enforce that provision on another occasion.

Entire Agreement: These Terms, together with the applicable estimate, work order, service authorization, invoice, Privacy Policy, and any transaction-specific written terms, constitute the applicable agreement concerning the authorized service. Transaction-specific written terms may supplement these Terms.

Conflicts: If a transaction-specific written term expressly conflicts with these general Terms, the more specific written term applicable to that transaction will control to the extent permitted by law.

Nothing in these Terms is intended to waive any right or obligation that cannot legally be waived.

18. Governing Law & Contact Information

Governing Law: These Terms & Conditions are governed by applicable federal law and the laws of the State of Alabama, without limiting any rights or remedies that cannot legally be waived.
